Senior Check-up (preventive Exams): CBC - Complete Blood Count, CMP - Complete Metabolic Panel, lipid panel, TSH - Thyroid Stimulating Hormone, Testosterone, HEMOGLOBIN A1C, urinalysis, PSA - Prostate Specific Antigen, or pap smear, EKG, occult fecal Blood, Chest XR, including Follow-Up Call Within 7 Days.
2. LIMITATIONS, EXCLUSIONS, AND EXCEPTIONS
- VIP Membership Plan is an annual plan with monthly payments that include some of the services provided by VIP Walk-In Clinic and is NOT A HEALTHCARE INSURANCE PLAN. VIP Walk-In Clinic is not a licensed insurer, broker, government entity, or other healthcare insurance.
- The VIP Membership plan’s usage is exclusive to registered members at the time of purchase and cannot be used fully or partially by non-members.
- The first check-up can be used only 30 days after contracting the Membership Plan, in the case of family plans, the other check-ups can be used every 30 days.
- Early use of Check-up packages may be available upon request after making advance payment of a monthly charge for each yearly check-up.
- If the plan holder is assisted by any other physician, healthcare provider, or medical office outside of our practice, VIP Walk-In Clinic will not be responsible for any costs or fees related to such visits. The Plan covers services provided only directly by VIP Walk-In Clinic.
- If any third-party services or tests are required after consultation under this plan (i.e., X-ray, ultrasound, CT SCAN, MRI, etc.), such third-party services are the sole economic responsibility of the plan holder as they are not included in the VIP Advantage Membership Plan. Additionally, any services needed by the plan holder at the VIP Walk-In Clinic outside the plan will be billed separately as they will not be part of the plan.
- Discounts cannot be applied to any other discount plan or program. The prices listed for all services provided by VIP Walk-In Clinic are subject to change without notice.
- We reserve the right to make any medical staff change at any time without notice to the plan holder. Any change within our medical staff is subject to internal regulations without notice and the plan holder acknowledges that VIP Walk-In Clinic solely decides which medical professional will examine the plan holder during each visit.
3. COMPLAINT PROCEDURES
To file a complaint regarding the use of your VIP Membership Plan, you must submit your formal written complaint by postal mail to: VIP Walk-In Clinic 12139 S. Apopka Vineland Rd. Orlando, FL 32836, or via email to: sales@vipwalkinclinic.com. Your claim will be analyzed upon confirmation of receipt by VIP Walk-In Clinic’s Sales Department, which will take the proper actions according to our internal rules and regulations.
4. PAYMENT AND RENEWAL CONDITIONS
By joining our VIP Membership Plan, the plan holder authorizes VIP Walk-In Clinic to automatically charge the debit or credit card (provided by the plan holder at the time of purchase). Membership plans purchased between the 1st and the 15th of the month will be charged either on the 14th or 15th of each month. Membership plans made between the 16th and 31st of the month will be charged either on the 29th or 30th of each month. Membership plans will be automatically renewed for an additional twelve months under the terms and conditions valid at the time of renewal, and under new prices if applicable. Suppose the patient does not want the Membership plan to be automatically renewed for another 12 months. In that case, the patient must email info@vipwalkinclinic.com, requesting automatic renewal not be processed 30 days before the end of the membership cycle. Failure to receive the email within 30 days before completion will indicate the patient's intent to continue with Membership and guarantee VIP Walk-in Clinic the right to renew the plan automatically.
5. CANCELLATION POLICY:
VIP Walk-In Clinic will not accept early termination of the membership plan during the twelve (12) month term.
If an extraordinary event occurs, VIP Walk-In Clinic will be responsible for reviewing and approving requests for early cancellation, however, the Plan Holder is acquiring a promotional service package and will enjoy a promotional price rate as long as the Plan Holder finishes his/her treatment subject to the terms of this Agreement. If the Plan Holder chooses to terminate this Agreement, before 12 months, the Plan Holder will lose the right to the promotional price rate and shall pay full price for each procedure by the Plan Holder until the time of termination. In addition, the Plan Holder shall pay a termination fee equal to fifteen percent (15%) for each full month of Service Commitment to the term of this Agreement.
6. TERMINATION OF SERVICES
VIP Walk-In Clinic may terminate this Agreement if the plan holder: 1. Fails to pay when due a required payment; 2. Fails to show up for (and reschedule) more than 2 appointments, and 3. Violates any other obligation under this agreement.
7. MISCELLANEOUS PROVISIONS

- LIMITATION OF LIABILITY. IN NO EVENT WILL VIP, ITS SUBSIDIARIES AND AFFILIATES, ITS LICENSEES, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE MEMBERSHIP PLANS, THESE PROGRAM RULES, OR THE COMPANY’S OPERATION OF THE LOYALTY PROGRAM.
- VENUE AND GOVERNING LAW. Any disputes arising from or related to this Agreement, or these Program Terms and Conditions will be managed individually without any class action. They will be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to the Loyalty Program or the Program Terms and Conditions may be filed only in the state or federal courts in Orange County, Florida.
- WAIVER. A waiver of any breach by the policyholder of this Agreement will not constitute a waiver of any other prior or subsequent breach of this Agreement. VIP’s failure to insist upon strict compliance with these terms will not be deemed a waiver of any rights or remedies that VIP may have against policyholders.
- ARBITRATION. Any controversy or claim arising out of or relating to this Agreement or the breach, termination, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association ("AAA") and conducted by a sole Arbitrator ("Arbitrator'') following the AAA's Commercial Arbitration Rules ("Rules"). The arbitration shall be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1-16, to the exclusion of state laws inconsistent therewith or that would produce a different result, and judgment on the award rendered by the Arbitrator (the "Award") may be entered by any court having jurisdiction thereof.
- SEVERABILITY. Any determination that any provision of this Agreement or any application thereof is invalid, illegal, or unenforceable in any respect in any instance shall not affect the validity, legality, and enforceability of such provision in any other instance, or the validity, legality, or enforceability of any other provision of this Agreement. Neither Party shall assert or claim that this Agreement or any provision hereof is void or voidable if such Party performs under this Agreement without prompt and timely written objection.
- ASSIGNMENT. This Agreement cannot be assigned to another party without express written authorization from the VIP Walk-In Clinic.
- ENTIRE AGREEMENT. This Agreement (including any attached schedules, appendices, and/or addenda) constitutes the complete and sole contract between the Parties regarding the subject matter described above and supersedes all prior or contemporaneous oral or written representations, communications, proposals, or agreements not expressly included in this Agreement and may not be contradicted or varied by evidence of prior, contemporaneous or subsequent oral representations, communications, proposals, agreements, prior course of dealings or discussions of the Parties. The Parties understand and agree that this Agreement only applies to the Plans described in this Agreement and, likewise, this Agreement does not and will not supersede any agreement(s) between Company's affiliates and Provider that relates to Company's affiliates other lines of business that are not the subject of this Agreement (that are not the Plans described in this Agreement).
- SIGNATURES. Facsimile and electronic signatures shall be deemed to be original signatures for all purposes of this Agreement.
- AMENDMENTS. This Agreement constitutes the entire understanding of the Parties hereto and no changes, amendments or alterations shall be effective unless signed by both Parties, except as expressly provided herein.
THIS IS A VALID IN BINDING CONTRACT, BY SIGNING BELOW YOU ARE AGREEING TO THE TERMS AND CONDITIONS OF YOUR CHOSEN PLAN.

2. LIMITAÇÕES, EXCLUSÕES E EXCEÇÕES
- O Plano de Afiliação VIP é um plano anual com pagamentos mensais que inclui alguns dos serviços prestados pela Clínica VIP Walk-In e NÃO É UM PLANO DE SEGURO DE SAÚDE. A Clínica VIP Walk-In não é uma seguradora, corretora, entidade governamental ou outro seguro de saúde licenciado.
- A utilização do plano de adesão VIP é exclusiva para membros registados no momento da compra e não pode ser utilizado total ou parcialmente por não-membros.
- O primeiro check-up só pode ser utilizado 30 dias após a contratação do Plano de Adesão, no caso de planos familiares, os outros check-ups podem ser utilizados a cada 30 dias.
- A utilização antecipada dos pacotes de check-up pode ser disponibilizada mediante pedido, após pagamento antecipado de mensalidade por cada check-up antecipado.
- Se o titular do plano for assistido por qualquer outro médico, prestador de cuidados de saúde, ou consultório médico fora da nossa clínica, a Clínica VIP Walk-In não será responsável por quaisquer custos ou honorários relacionados com tais visitas. O Plano cobre os serviços prestados apenas directamente pela Clínica VIP Walk-In.
- Se quaisquer serviços ou testes de terceiros forem necessários após consulta ao abrigo deste plano (i.e., Raio-X, ultrassom, CT SCAN, MRI, etc.), tais serviços de terceiros são da exclusiva responsabilidade financeira do titular do plano, uma vez que não estão incluídos no Plano de Adesão VIP Advantage. Além disso, quaisquer serviços necessários ao titular do plano na Clínica VIP Walk-In fora do plano serão facturados separadamente, uma vez que não farão parte do plano.
3. PROCEDIMENTOS DE QUEIXA
Para apresentar uma queixa relativa à utilização do seu Plano de Afiliação VIP, deve apresentar a sua queixa formal por escrito por correio postal: VIP Walk-In Clinic 12139 S. Apopka Vineland Rd. Orlando, FL 32836 ou via e-mail para: sales@vipwalkinclinic.com. A sua reclamação será analisada após confirmação da recepção pelo Departamento de Vendas da Clínica VIP Walk-In, que tomará as medidas adequadas de acordo com as nossas regras e regulamentos internos.
4. CONDIÇÕES DE PAGAMENTO E RENOVAÇÃO
Ao aderir ao nosso Plano de Adesão VIP, o titular do plano autoriza a Clínica VIP Walk-In a carregar automaticamente o cartão de débito ou crédito (fornecido pelo titular do plano no momento da compra). Os planos de adesão adquiridos entre os dias 1 e 15 do mês, serão cobrados ou no dia 14 ou 15 de cada mês. Os planos de adesão feitos entre os dias 16 e 31 do mês, serão cobrados ou no dia 29 ou 30 de cada mês. Os planos de adesão serão automaticamente renovados por mais doze meses nos termos e condições válidos no momento da renovação, e sob novos preços, se aplicável. Se por qualquer razão o paciente não quiser que o plano de adesão seja renovado automaticamente por mais 12 meses, deverá enviar um e-mail para info@vipwalkinclinic.com, solicitando que a renovação automática não seja processada 30 dias antes do fim do ciclo de adesão. A não recepção do e-mail no prazo de 30 dias antes da conclusão indicará a intenção do paciente de continuar com a adesão e garantirá à Clínica VIP Walk-in o direito de renovação automática do plano.
5. POLÍTICA DE CANCELAMENTO:
A Clínica VIP Walk-In não aceitará a rescisão antecipada do plano de adesão durante o período de doze (12) meses.
Se ocorrer um evento extraordinário, a Clínica Walk-In VIP será responsável por rever e aprovar pedidos de cancelamento antecipado, no entanto, o Titular do Plano está adquirindo um pacote de serviços promocionais e usufruirá de uma taxa de preço promocional desde que o Titular do Plano termine o seu tratamento sujeito aos termos do presente Acordo. Se o Titular do Plano optar por rescindir este Acordo, antes de 12 meses, o Titular do Plano perderá o direito à tarifa de preço promocional e pagará o preço total por cada procedimento pelo Titular do Plano até o momento da rescisão. Além disso, o Titular do Plano pagará uma taxa de rescisão igual a quinze por cento (15%) por cada mês ainda em aberto do Compromisso de Serviço durante a vigência do presente acordo.
6. CESSAÇÃO DE SERVIÇOS
VIP Walk-In Clinic pode rescindir este Acordo se o titular do plano: 1. Não pagar quando é devido um pagamento exigido; 2. Não comparecer para (e reprogramar) mais de 2 marcações, e 3. Violar qualquer outra obrigação ao abrigo deste acordo.
7. DISPOSIÇÕES DIVERSAS
- LIMITAÇÃO DA RESPONSABILIDADE. EM HIPÓTESE ALGUMA A VIP, SUAS SUBSIDIÁRIAS E AFILIADAS, SEUS LICENCIADOS E CADA UM DE SEUS RESPECTIVOS DIRETORES, OFICIAIS, FUNCIONÁRIOS E AGENTES SERÃO RESPONSÁVEIS POR QUAISQUER DANOS DIRETOS, INDIRETOS, ESPECIAIS, EXEMPLARES, PUNITIVOS, INCIDENTAIS OU CONSEQUENCIAIS DE QUALQUER TIPO, SEJAM BASEADO EM CONTRATO, ATO ILÍCITO OU DE OUTRA FORMA, QUE DECORREM OU ESTÃO DE QUALQUER FORMA RELACIONADOS COM OS PLANOS DE ASSOCIAÇÃO, ESTAS REGRAS DO PROGRAMA OU COM A OPERAÇÃO DO PROGRAMA DE FIDELIDADE DA EMPRESA.
- LOCAL E LEI QUE REGE O PROGRAMA. Quaisquer disputas decorrentes ou relacionadas a este Contrato ou a estes Termos e Condições do Programa serão tratadas individualmente, sem qualquer ação coletiva. Eles serão regidos, interpretados e aplicados de acordo com as leis do Estado da Flórida, Estados Unidos, independentemente de seus conflitos de regras legais. A jurisdição exclusiva para qualquer reclamação ou ação decorrente ou relacionada ao Programa de Fidelidade ou aos Termos e Condições do Programa poderá ser apresentada apenas nos tribunais estaduais ou federais em Orange County, Flórida.
- RENÚNCIA. A renúncia a qualquer violação deste Contrato por parte do segurado não constituirá uma renúncia a qualquer outra violação anterior ou subsequente deste Contrato. A falha da VIP em insistir no cumprimento estrito destes termos não será considerada uma renúncia a quaisquer direitos ou recursos que a VIP possa ter contra os segurados.
- ARBITRAGEM. Qualquer controvérsia ou reclamação decorrente ou relativa ao presente Contrato ou à violação, rescisão ou validade do mesmo, será resolvida por arbitragem vinculativa administrada pela Associação Americana de Arbitragem ("AAA") e conduzida por um único Árbitro ("Árbitro") em conformidade com as Regras de Arbitragem Comercial ("Regras") da AAA. A arbitragem será regida pela Lei Federal de Arbitragem, 9 U.S.C. §§ 1-16, com a exclusão de leis estatais inconsistentes com a mesma ou que produziriam um resultado diferente, e o julgamento da sentença proferida pelo Árbitro (a "Sentença") pode ser introduzido por qualquer tribunal com jurisdição sobre a mesma.
- SEVERABILIDADE. Qualquer determinação de que qualquer disposição do presente Acordo ou qualquer aplicação do mesmo é inválida, ilegal ou inaplicável em qualquer aspecto em qualquer instância não afectará a validade, legalidade e aplicabilidade de tal disposição em qualquer outra instância, ou a validade, legalidade ou aplicabilidade de qualquer outra disposição do presente Acordo. Nenhuma das Partes poderá afirmar ou alegar que o presente Acordo ou qualquer disposição do mesmo é nulo ou anulável se tal Parte actuar ao abrigo do presente Acordo sem objecção escrita pronta e atempada.
- RESPONSABILIDADE. O presente Acordo não pode ser atribuído a outra Parte sem a autorização expressa por escrito da Clínica VIP Walk-In.
- ACORDO NA ÍNTEGRA. O presente Acordo (incluindo quaisquer cronogramas, apêndices e/ou adendas em anexo) constitui o contrato completo e único entre as Partes relativamente ao assunto acima descrito e substitui toda e qualquer declaração, comunicação, proposta ou acordo anterior ou contemporâneo, oral ou escrito, não expressamente incluído no presente Acordo e não pode ser contradito ou alterado por provas de declarações orais anteriores, contemporâneas ou posteriores, comunicações, propostas, acordos, curso prévio das negociações ou discussões das Partes. As Partes compreendem e concordam que este Acordo só se aplica aos Planos descritos neste Acordo e, da mesma forma, este Acordo não substitui e não substituirá qualquer acordo(s) entre as afiliadas da Empresa e o Fornecedor que se relacione com as afiliadas da Empresa outras linhas de negócio que não sejam objecto deste Acordo (que não sejam os Planos descritos neste Acordo).
- ASSINATURAS. As assinaturas fac-símile e electrónicas serão consideradas como assinaturas originais para todos os efeitos do presente Acordo.
- ALTERAÇÕES. O presente Acordo constitui o entendimento total das Partes do presente Acordo e nenhuma alteração, emenda ou alteração será efectiva a menos que seja assinada por ambas as Partes, salvo se expressamente previsto no presente Acordo.
ESTE É UM CONTRATO VÁLIDO E VINCULATIVO, AO ASSINAR ABAIXO ESTÁ A CONCORDAR COM OS TERMOS E CONDIÇÕES DO PLANO ESCOLHIDO.
